Phaboo Trade S.r.l. (following Phaboo) with registered office in Buccinasco (MI) Via Crimea n. 4 (ZIP 20090) TIN and VAT No. 08367330969 is the owner of http://www.u-cook.it website.
Phaboo Trade S.r.l. purchases and delivers different products throughout Italy.
The following general purchasing conditions regulate business relationship between Phaboo and the Customer.
2.1 The contract agreed between Phaboo and the Customer is considered concluded with the, even only partial, acknowledgement of the order by Phaboo. Such acknowledgement is communicated through e-mail, according to what is best specified in the clause 3. By making an order under the provided conditions, the Customer declares having taken notes of all the indications given during the purchasing procedure and to agree with the following general payment conditions.
2.2 If the Customer is a consumer, that is an individual buying goods for non-professional purpose, once the online purchasing procedure has been concluded, s/he will arrange for the maintenance of the present purchasing conditions, by printing it or saving a copy, in accordance with Art. 50 and ff. of Legislative Decree no. 206/05.
2.3 Any Customer right of compensation for damages or indemnity is excluded, together with any contractual or non-contractual responsibility for direct or indirect injuries to people and things, caused by the, also partial, lack of acknowledgement of an order.
3.1 The Customer can only buy products present in the electronic catalogue of the http://www.u-cook.it web site at the moment of submitting an order, as they are described in the factsheet. Agreed that the picture supplied with a product factsheet might not represent some of the product features perfectly, such as colour, dimensions or accessories. All information supporting the purchase (Glossary, Purchasing Guide, etc…) has to be understood as simple and generic informative material, not referring to the real features of the single product.
3.2 Phaboo confirms the purchasing of the product and the correct reception of the order through two different e-mails, sent to the address provided by the Customer. The first e-mail confirms the order acknowledgement and the payment reception. The second one confirms the submit of the shipment request to the logistic service. This confirmation e-mail contains information about lead Date and Time together with an Order Number to be used in any further communication with Phaboo. The message relates all data provided by the Customer, who has to verify its correctness and to promptly communicate any possible correction to Phaboo.
3.3 In the event of non-acknowledgement, Phaboo guarantees a prompt communication to the Customer.
4.1 Credit card: for goods purchase by Credit Card as payment procedure, the charge is made at the moment of the order execution.
4.2 Phaboo reserves the right to request the Customer integrative information (e.g. landline telephone number) or the sending of a document copy proving the ownership of the Card used. In the absence of the required documentation, Phaboo reserves the right to refuse the order.
4.3 At no time during the purchase process Phaboo is able to know Customer credit card information, as this data is provided directly to the web site of the bank handling the transaction, through a secure connection. Phaboo can only keep this data under explicit request and consent of the Customer: in this case, Phaboo guarantees the data storage in accordance with certified security standards and always visible in mask mode.
4.4 PayPal Purchases: for goods purchased by PayPal as payment procedure, at the moment of the online transaction execution, PayPal will provide for the immediate charge of the total amount concerning the purchase.
4.5 Advance bank transfer: through bank transfer, specifying in the reason for the payment the code issued by the system. By accepting the purchasing conditions and clicking on the buy button, the Customer peremptorily undertakes the payment through bank transfer no later than 3 days, otherwise the order will be cancelled. IBAN, and other data needed for the payment, is communicated by e-mail. The two e-mails referred to in clause 3.2 will be sent after the executed deposit on the Phaboo current account.
5.1 Phaboo can only accept delivery orders throughout Italy, San Marino and Vatican City.
5.2 Phaboo emits the accompanying invoice of shipped material for any order made on the http://www.u-cook.it web site. For the issue of the invoice, is considered authentic the information provided by the Customer upon ordering. Once the invoice has been issued, any variation will no longer be allowed.
5.3 Except in the case of promotions specified on the web site, delivery costs are charged to the Customer and clearly explicated upon ordering. Nothing is due to the Customer apart from the order total amount.
5.4 Phaboo undertakes to deliver the U-Cook goods to the destination indicated by the Customer within a period of maximum 5 (five) working days, from the date of confirmation (sent by e-mail) of the order submission. For Christmas gift baskets there is maximum period of 12 (twelve) working days.
5.5 No responsibility can be attributed to Phaboo in case of courier delay, order evasion or delivery of what has been ordered.
We provide street-level delivery services only, except for:
- different communication of our customer service,
- what expected in the product factsheet,
- the explicit purchase of a floor delivery service, when available.
At the moment of delivery by the courier, Customer must check:
- that the number of delivered items corresponds to what indicated in the accompanying invoice;
- that packaging is intact, not damaged, wet or altered in any way, also in its closing materials (adhesive tape or bands).
Possible packaging and/or product damages, the non-correspondence of the number of items or indication, must be immediately notified, writing a reservation of control (specifying the cause of reservation, e.g. “perforated packaging”, “crushed packaging”, etc…) on courier’s proof of delivery. Once the courier document has been signed, Customer will not be able to make any more claim for the exterior features of what has been delivered.
Any problems regarding the physical integrity, the correspondence or the completeness of the received products must be notified within 7 days, from the date of delivery, according to the procedures expected by the present document.
5.6 In the event of non-collection within 7 working days of the stored material in the courier warehouse, due to repeated impossibility to deliver to the address provided by the Customer upon ordering, the product ordered will be delivered back to Phaboo warehouses.
6.1 In accordance with Art. 64 and ff. of Legislative Decree no. 206/05, if the Customer is a consumer (that is an individual buying goods for non-professional purpose, or rather, who does not purchase indicating a reference of a VAT number on the order form), s/he has the right of withdraw from the purchasing contract for any reason, without the need of explanation and with no sanction.
6.2 To exercise this right, the Customer must contact the Phaboo customer service, within 30 working days, from the date of delivery, declaring the intention to exercise the right of withdrawal:
By telephone, calling the number 0363/382960 (maximum cost by Telecom landline telephone is 1.90 €cent/minute with 7.94 €cent more for connection fee). Phone costs vary in accordance with the telephone company used for the call.
By registered letter, with acknowledgement of receipt to the following address:

6.3 A Phaboo operator will permit you to set an appointment for the collection of a courier sent by Phaboo at the Customer’s residence. Customer will not be charged for the product redeliver. Moreover, Phaboo will re-credit, within 30 days, from the date of goods return, the total amount after verifying the integrity of goods and withholding the amount of shipping costs only. Refund will be applied in accordance with the same procedures the Customer used for the payment. In the event of bank transfer, the Customer must promptly provide the banking details (IBAN and account holder) in order to obtain the refund, if they are different from the ones used for the payment. In the event of PayPal or credit card payment, the refund will be charged on the same card used for the purchase. Refund times are at discretion of the referring bank institute and PayPal, they do not depend on Phaboo.
6.4 Right of withdrawal is subjected to the following conditions:
- the right is applied to the entire purchased product; it is not possible to exercise the withdrawal on a part of the purchased product only (e.g.: accessories, wires, etc…);
- the right is clearly not applied to tailored or personalised products;
- the purchased good must be intact and returned into its original box, with all its parts (including packaging, any documentation and accessories: manuals, wires, etc…). In order to limit damages to the original package, we recommend you to put it in an extra box, on which you must place the tag given by Phaboo, containing the RMA (Return Merchandise Authorization) number. The placement of any tag or adhesive tape directly on the original package of the product must be avoided;
- at its arrival in the warehouse, the product will be examined in order to check any possible damages or alteration not due to transportation.
In the event of lack of conditions for exercising the right of withdrawal, goods will be held at Phaboo offices at Customer’s disposal for the collection at his/her exclusive charge.
7.1 All products sold by Phaboo are covered by the manufacturer's standard warranty, if existing, and by a 24-mounth warranty for lacks of conformity, in accordance with Legislative Decree no. 206/05. Customer must keep the invoice in order to benefit from warranty service.
7.2 The 24-mounth warranty, in accordance with Legislative Decree no. 206/05, is applied to a product manifesting a lack of conformity, provided that the same product has been used correctly, respecting its usage purpose and in accordance to any annexed technical report. Such warranty is intended for private Customer only. In the event of lack of conformity, Phaboo provides for the reactivation of the product conformity, with no charge for the Customer, through the replacement with a new product or, in the event of stock depletion, with a product in same features and market value.
7.3 If warranty expects the product restitution, Customer must return the product in its original package, with all its parts (including packaging, any documentation and accessories: manuals, wires, etc…). In order to limit damages to the original package, we recommend you to put it in an extra box. The placement of any tag or adhesive tape directly on the original package of the product must be avoided. Customer will be provided with a Return Merchandise Authorization (RMA) number, which must be indicated on the external part of the package, following the instructions provided with the authorization e-mail.
7.4 Lacks of conformity can be notified through the same procedures expected for the right of withdrawal, contacting the following e-mail address: email@example.com.
8.1 The sales contract between the Customer and Phaboo is considered concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of the present contract of sale at a distance, if the Customer is a consumer, the local jurisdiction is that of the reference Court of his/her town of residence: in all other cases, the exclusive local jurisdiction is the Court of Milan.
